District Bylaws

ARTICLE I
LOCATION

THE CHUGWATER CEMETERY DISTRICT IS LOCATED ON THE NE CORNER OF THE NW QUARTER, SECTION 35, TOWNSHIP 21N, RANGE 66W.

PURPOSE

THESE BYLAWS DESCRIBE THE RULES AND REGULATIONS GOVERNING THE MANAGEMENT, OPERATIONS AND USE OF THIS FACILITY.

ARTICLE II
OFFICERS

SECTION 1. The officers shall be President, Vice President, Recording Secretary, Corresponding Secretary, Treasurer, and Historian.

SECTION 2. These officers shall perform the duties prescribed by these laws.

SECTION 3. DUTIES OF THE OFFICERS:

PRESIDENT. The President shall preside over business meetings and appoint committees as necessary.

VICE PRESIDENT. The Vice President shall assume the duties of the President as needed.

RECORDING SECRETARY. The Recording Secretary shall keep a record of all business meetings and other transactions as necessary.

CORRESPONDING SECRETARY. The Corresponding Secretary shall write letters as necessary.

TREASURER. The Treasurer shall keep an accurate record of income and expenditures. The Treasurer shall write checks in payment for legitimate bills. The Treasurer shall collect the income provided by the mill levy from Platte and Goshen Counties and keep a record of all donations.

HISTORIAN. The Historian shall keep records of sales of burial plots and lots, of burials and their locations, and of any historical information

regarding the Cemetery.

SECTION 4. Officers are elected for a term of four years by the electorate of the Cemetery District. Three officers are elected every two years at the general election with the other three being elected the following general election.

ARTICLE III
MEETINGS

SECTION 1. Meetings shall be called by common consent of the officers.

SECTION 2. A quorum shall consist of four or more officers.

ARTICLE IV
COMMITTEES

SECTION 1. Standing committees may be appointed and terminated by the president with the approval of the officers.

ARTICLE V
AMENDMENT OF BYLAWS

SECTION 1. These bylaws may be amended at any regular meeting of the officers by a two-thirds majority vote, provided that amendment has been submitted in writing at the last previous regular meeting.

ARTICLE VI
PARLIAMENTARY AUTHORITY

SECTION 1. Parliamentary Authority is the Scott, Foresmen, Roberts’ Rules of Order Newly Revised copyright 2011.

ARTICLE VII
DEFINITIONS

SECTION 1. Burial plot means the space for one grave, 4’ x 8’.

SECTION 2. Burial lot means the space 16’ x 16’ or 12’ x 16’.

SECTION 3. Monument means a tombstone, a grave marker, a headstone, or a combination of these.

SECTION 4. Cemetery means the Chugwater Cemetery District grounds at 282 JJ Road.

SECTION 5. Board means the officers of the Cemetery District.

ARTICLE VIII
CARE OF THE CEMETERY

SECTION 1. All grading, general landscaping work, improvements, all openings and closings of graves, any interment, disinterment or removal and placement of monuments shall be made under the direction of the officers of the Cemetery.

SECTION 2. Lots may be sold by any officer of the Cemetery. Selling officer shall consult Cemetery Plat regarding availability of lot before consummating a sale. Selling officer shall then notify other officers of said sale.

SECTION 3. The price of all lots shall be $200.00. Officers will have current Memorial Wall plaque pricing.

SECTION 4. No pets or animals will be buried in this Cemetery.

SECTION 5. No “stack” or “green” burials will be allowed in the Cemetery. Inclement weather may delay interment.

SECTION 6. The use of any lot or plot in the Cemetery is hereby restricted to burial purposes. Planting of trees, shrubs, plants, flowers and grass is prohibited unless approved by the Board.

SECTION 7. Any permanent or semi-permanent grave decoration must be placed within the boundaries of the monument.

SECTION 8. Monument size will be limited to no more that 4 feet long, 10 inches wide, and 4 feet high. A foundation extending 5 inches beyond the monument on each side at ground level and 4 inches deep is required for the monument. Monuments placed in Blocks H, J, K, L, N, P, Q and R will be located on the West side of the Lot.

SECTION 9. The custodian of the Cemetery is authorized to remove any illegally constructed structure or fence, or any illegally planted tree or shrub. When any fence, curbing or other structure now in the Cemetery shall become in a state of disrepair by reason of deterioration, vandalism, or any other reason, the custodian is authorized to remove the same. These duties shall be performed only after consulting with the Board. All grave decorations for special occasions are to be removed 1 week after placement.

SECTION 10. The resale of Cemetery lots or plots is forbidden, except back to the Cemetery. Such resale shall be for the same amount originally paid by the owner.

SECTION 11. Burial of cremation ashes is limited to two (2) urns per burial plot. There shall not be any standing monuments in the middle of the burial plots.

SECTION 12. There shall be a two (2) lot limit, per family, ownership restriction. Anyone wanting more that two (2) lots shall be required to submit their request in writing to the Board.

SECTION 13. The Cemetery Building is available for Funerals and Memorial Services at no charge. All other events will be charged $130 per event. Events require prior approval by the Board.

SECTION 14. Memorial Wall plaques are available for individuals who are not currently interred, nor will be interred in the future, within the Chugwater Cemetery.
